The Site and all of its contents, features, and functionality (including, but not limited to, all information, software, text, displays, images, video, and audio, and the design, selection, and arrangement thereof; collectively, "REFORMadison Content"); the name "REFORMadison;" and REFORMadison logos, symbols, and slogans are copyrighted, trademarks, service marks, or trade dress by or of REFORMadison ("REFORMadison Intellectual Property"). REFORMadison Intellectual Property may not be copied, republished, or distributed without the prior written consent of REFORMadison. 

User Conduct

Each User agrees to use the Site only for lawful purposes and in accordance with these Terms and Conditions. 

Links From The Site

Each User acknowledges and agrees that: (a) any links to other sites (including, but not limited to, other sites for the purpose of booking a class provided by REFORMadison) contained on the Site are provided for such User's convenience only; (b) REFORMadison has no control over such other sites or the contents of such other sites; (c) REFORMadison accepts no responsibility for such other sites, the contents of such other sites, or any loss or damage that may arise from such User's use of such other sites or the contents of such other sites; and (d) any use of such other sites or contents of such other sites by such User is at such User's own risk and subject to any terms and conditions of use of such other sites. 

Disclaimer of Warranties

EACH USER AGREES THAT SUCH USER'S USE OF THE SITE OR REFORMADISON CONTENT IS UNDERTAKEN AT SUCH USER'S OWN RISK. REFORMADISON MAKES NO REPRESENTATION, WARRANTY, OR GUARANTY: (A) AS TO THE RELIABILITY, TIMELINESS, QUALITY, SUITABILITY, TRUTHFULNESS, AVAILABILITY, SECURITY, ACCURACY, OR COMPLETENESS OF THE SITE OR REFORMADISON CONTENT; (B) THAT THE SITE WILL OPERATE IN COMBINATION WITH ANY OTHER HARDWARE, SOFTWARE, SYSTEM, OR DATA; (C) THAT THE SITE OR REFORMADISON CONTENT WILL MEET ANY USER'S REQUIREMENTS OR EXPECTATIONS; OR (D) THAT THE SITE 2

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, REFORMADISON SHALL NOT BE LIABLE FOR, AND EACH USER HEREBY AGREES TO HOLD REFEORMADISON HARMLESS FROM, ANY DAMAGES, INCLUDING, BUT NOT LIMITED TO, DIRECT, INDIRECT, SPECIAL, INCIDENTAL, AND CONSEQUENTIAL DAMAGES, OR LIABILITY, INCLUDING, BUT NOT LIMITED TO, WITH RESPECT TO PERSONAL INJURY, PAIN AND SUFFERING, EMOTIONAL DISTRESS, LOSS OF REVENUE, LOSS OF PROFITS, LOSS OF BUSINESS OR ANTICIPATED SAVINGS, LOSS OF USE, LOSS OF GOODWILL, AND LOSS OF DATA, WHETHER CAUSED BY TORT, BREACH OF CONTRACT, OR OTHERWISE, RESULTING FROM OR ARISING OUT OF: (A) SUCH USER'S USE OF OR INABILITY TO USE THE SITE; (B) REFORMADISON CONTENT; (C) DELAYS OR DISRUPTIONS WITH THE SITE; (D) VIRUSES OR OTHER MALICIOUS SOFTWARE OBTAINED BY ACCESSING OR LINKING TO THE SITE; (E) GLITCHES, BUGS, ERRORS, OR INACCURACIES OF ANY KIND WITH RESPECT TO THE SITE OR REFORMADISON CONTENT; OR (F) DAMAGE TO SUCH USER'S HARDWARE DEVICE RESULTING FROM USE OF THE SITE. IN NO EVENT SHALL REFORMADISON BE LIABLE TO ANY USER IN AN AMOUNT EXCEEDING $100. THE FOREGOING DOES NOT AFFECT ANY DAMAGES OR LIABILITY THAT CANNOT BE EXCLUDED OR LIMITED UNDER APPLICABLE LAW. 

Indemnification

Each User hereby agrees to indemnify, defend, and hold harmless REFORMadison for any liabilities or damages suffered by REFORMadison resulting from or arising out of such User's: (a) violation of these Terms and Conditions, any statute, regulation, ordinance, or other law, or any right of any person; or (b) improper use of the Site or REFORMadison Content. 

Governing Law and Jurisdiction

These Terms and Conditions shall be governed by and construed in accordance with the laws of the State of Wisconsin. Any claim or dispute between REFORMadison and any User shall be resolved exclusively by a State or Federal court located in Dane County, Wisconsin. Each User hereby agrees to submit and consents to the personal jurisdiction of the courts located in Dane County, Wisconsin. 3 

No Waiver

Any provision of these Terms and Conditions may be waived only by a written instrument executed by REFORMadison. The failure of REFORMadison at any time to require performance of any provision contained in these Terms and Conditions by any User shall, in no manner, affect the right of REFORMadison at a later date to enforce the same. No waiver by REFORMadison of any provision contained in these Terms and Conditions, whether by conduct or otherwise, in any one or more instances, shall be deemed to be or construed as a further or continuing waiver of any such or any other provision of these Terms and Conditions. 

Amendment

REFORMadison may, in its sole discretion, amend these Terms and Conditions from time to time. The "Effective as of" date displayed at the bottom of this page will be updated when REFORMadison amends these Terms and Conditions. If any User does not agree with these Terms and Conditions, as amended from time to time, such User shall discontinue his or her use of the Site. These Terms and Conditions may not be amended except as provided in this Amendment provision. 

Severability

If any term or provision contained in these Terms and Conditions shall be held to be invalid, illegal, or unenforceable in any respect, in whole or in part, by a judgment, order, or decree of any court of competent jurisdiction, the validity of the remaining terms and provisions, and of the remaining part of any term or provision held to be partially invalid, illegal, or unenforceable, shall continue in full force and effect to the extent permitted by the terms of such judgment, order, or decree. 

Entire Agreement

These Terms and Conditions contain and constitute the entire agreement between REFORMadison and each User with regard to the Site.
